Terms of Service

The plain-language version: use Moneypod responsibly, your data stays yours, and here's what we're each responsible for.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Moneypod mobile application and this website (together, the "Service"), operated by Moneypod ("we", "us", "our"). By creating an account or using Moneypod, you agree to these Terms. If you don't agree, please don't use the Service. Our Privacy Policy explains how we handle your data and is incorporated into these Terms by reference.

2. Eligibility

You must be at least 18 years old to use Moneypod, consistent with the age requirements of the mobile money services it connects to (M-Pesa and Airtel Money). By using the Service, you confirm that you meet this requirement and that you're legally able to enter into these Terms.

3. Description of the Service

Moneypod is a personal finance tracker that reads M-Pesa and Airtel Money SMS notifications directly on your device to build an automatic transaction ledger. Depending on your plan, the Service may include:

  • Automatic transaction tracking across your M-Pesa and Airtel Money ledgers
  • A Debt Tracker, including automatic Fuliza tracking, manual debt entries, and receivables
  • Manual transactions for cash, bank, or other spending outside M-Pesa/Airtel Money
  • Budgets, spending insights, and financial summaries
  • Recurring payment reminders via push notification and/or email
  • PDF export of your reports

Some features are only available on our Premium plan or during your initial access period, as described in Section 5. Features such as bank account support and cross-device sync are planned but not yet available, and this page will be updated before they launch.

4. Accounts & Security

To use Moneypod, you'll create an account with an email address and password (or a supported sign-in method). You're responsible for keeping your login credentials confidential and for all activity that happens under your account. Let us know immediately at support@moneypod.co.ke if you suspect unauthorized access. Please provide accurate information when creating your account — it's how we reach you about your account and the Service.

5. Subscriptions, Free Access & Billing

WHAT'S FREE, WHAT'S PREMIUM

Moneypod's core tracking stays free to use for life — there's no forced expiry on the app itself. New accounts also get full access to Premium features for their first 30 days at no charge. After that, a lighter free-tier version of a few features (transaction history, budgets, insight depth, reminder channels, and support response time) applies unless you subscribe to Premium.

If you choose to subscribe to Premium, billing is handled through the Google Play Store (or another platform we may support in the future), not directly by Moneypod. Pricing, billing cycles, and cancellation are managed through that platform's subscription settings, and refunds are subject to that platform's own refund policies rather than ours. You can cancel anytime before your next billing date to avoid being charged again; cancelling doesn't delete your account or your local transaction data.

We may change Premium pricing or what's included in the free vs. Premium tiers going forward. If we do, we'll aim to notify existing subscribers in advance through the app or by email before any change affects them.

6. License & Acceptable Use

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Moneypod for your own personal financial tracking. In using the Service, you agree not to:

  • Reverse-engineer, decompile, or attempt to extract the source code of the app
  • Use the Service for any unlawful purpose, including money laundering or fraud
  • Attempt to interfere with, disrupt, or gain unauthorized access to the Service or its infrastructure
  • Scrape, resell, sublicense, or commercially exploit the Service without our written permission
  • Use automated means (bots, scripts) to interact with the Service outside normal app usage
  • Misrepresent your identity or impersonate another person when creating an account

We may suspend or terminate accounts that violate this section, as described in Section 13.

7. Your Content & Data

"Your Content" means anything you add yourself — manual transactions, debt entries, budget names, support messages, and similar input. You retain ownership of Your Content. You're responsible for making sure it's accurate; Moneypod can't verify manually entered figures, and insights built on inaccurate input will reflect that inaccuracy. As explained in our Privacy Policy, your SMS-derived transaction data is processed and stored locally on your device and isn't transmitted to our servers.

8. Intellectual Property

The Moneypod name, logo, app design, and underlying software are owned by us or our licensors and protected by applicable intellectual property laws. Nothing in these Terms transfers any of that ownership to you. The limited license in Section 6 lets you use the app — it doesn't give you rights to our brand, code, or design beyond that personal use.

9. Third-Party Services

Moneypod reads notifications from M-Pesa and Airtel Money, and Premium billing runs through the Google Play Store. We don't control these third-party services, and we're not responsible for their outages, errors, fees, or changes to how they operate — including changes to SMS formats that may temporarily affect parsing accuracy. Our website may also link to third-party platforms like Instagram or Facebook, which have their own terms and privacy practices.

10. No Financial Advice

Moneypod's insights, summaries, and observations are for informational purposes only. They are not financial, investment, tax, or legal advice, and shouldn't be treated as a substitute for professional guidance. Any decisions you make based on information from the Service are your own responsibility.


11. Limitation of Liability

To the maximum extent permitted by the laws of Kenya, Moneypod and its affiliates shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from:

  • Financial decisions made based on app insights or summaries.
  • Accuracy of parsed SMS data or manually entered figures.
  • Third-party payment network security or downtime (M-Pesa / Airtel Money / Google Play).
  • Any data loss due to device failure, loss, theft, or app uninstallation.
  • Service interruptions, bugs, or temporary unavailability.

Nothing in these Terms limits liability where doing so would be unlawful under Kenyan law.

12. Indemnification

You agree to indemnify and hold Moneypod and its affiliates harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

You can stop using Moneypod and delete your account at any time from within the app, or by contacting support@moneypod.co.ke. We may suspend or terminate your account if you violate these Terms, engage in fraudulent or unlawful activity, or if we're required to do so by law. Where reasonably possible, we'll notify you before termination and explain why.

14. Service Availability & Changes

We're actively building Moneypod, which means features, screens, and functionality may change, be added, or be removed over time — including the rollout of planned features like bank account support and cross-device sync. We don't guarantee uninterrupted or error-free access to the Service, and we may perform maintenance that temporarily affects availability.

15. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by Kenyan law.

16. Governing Law & Disputes

These Terms are governed by the laws of Kenya, including the Constitution of Kenya (2010) and the Data Protection Act (2019) where applicable. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Kenya. Before pursuing formal proceedings, we'd genuinely appreciate the chance to resolve things directly — reach out to us first.

17. Changes to These Terms

We may update these Terms as Moneypod evolves. Material changes will be communicated in-app or by email before they take effect, and the "Last updated" date at the top of this page will always reflect the current version. Continuing to use Moneypod after changes take effect means you accept the updated Terms.

18. General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with our Privacy Policy, make up the entire agreement between you and Moneypod regarding the Service, and supersede any prior agreements on the same subject. Our failure to enforce a provision isn't a waiver of our right to do so later.
